When something in your history is blocking the green card.

An approved petition is not the same as an approved green card. If a ground of inadmissibility applies to you, a waiver is what makes the case possible. Richards & Richards builds these from Ogden for families across Utah.

Your Immigration Attorney

Kevin Richards is federally admitted to practice immigration law in every state.

Kevin G. Richards

That's not a marketing claim. It's an actual federal credential — admission to the U.S. Immigration Court, all states. Kevin can represent a client in removal proceedings in any immigration court in the country, and does.

What that means for you:

  • If your case gets transferred to a different state's immigration court (ICE does this regularly with detained cases), you don't have to find a new attorney.
  • If your family member is in detention out of state, we can represent them there without handing the case off.
  • If you're appealing a denial to the BIA or the Tenth Circuit, Kevin handles both.

Kevin is also trilingual — fluent in English, Spanish, and Portuguese. Consultations happen in the language you're most comfortable in.

And: Kevin serves as a public defender in Weber County. He knows criminal-immigration consequences — the dangerous intersection where a small criminal matter triggers deportation — as well as anyone practicing in Utah.

Why Choose Richards & Richards for Your Waiver

Immigration cases turn on paperwork, deadlines, and who is reading your file. Here is what you get when you hire us.

1

You Get a Real Filing Plan

After your consultation you get a written summary of where you stand: which ground is actually blocking you, whether it can be waived, who your qualifying relative would be, what evidence the case needs, and what we intend to do about each.

2

One Attorney, One Point of Contact

The attorney on your case handles your case. You are not shuffled between five lawyers or handed to a paralegal who cannot make decisions. When you call, you reach the person who knows your file.

3

Federally Admitted in Every State

Kevin Richards is admitted to practice before the U.S. Immigration Court in every state. If your case is transferred, or a family member is detained somewhere else, it does not have to change hands.

4

We Are Transparent About Costs

You get our rate and retainer requirement upfront, plus an honest estimate of what the work costs through resolution. We also tell you plainly what we cannot promise, because no lawyer can promise you an outcome.

5

Clear Communication, Always

We answer calls and emails within 24 business hours. When something significant happens on your case, you hear it from a person, not a form letter. We explain what it means and what happens next.

6

A Family Firm Since 1988

I cannot say enough good things about Kevin and his team. Going through a high-conflict divorce and custody case has been one of the most stressful and emotionally draining experiences of my life, and Kevin has been a steady source of guidance, support, and reassurance throughout the entire process. From the very beginning, Kevin took the time to explain every step of the process, answer my questions, and help me understand what to expect. His calm and confident approach gave me peace of mind during some of the most difficult moments of my case…

Questions We Get About Immigration Waivers

Short answers to what people actually ask before they call.

What is an immigration waiver?
It is forgiveness of a specific legal ground that would otherwise block you. A waiver does not erase what happened. It asks the government to set aside that particular bar so your case can move forward. Each ground has its own waiver, its own standard, and its own form.
What does extreme hardship mean?
Hardship to your qualifying relative, not to you. That is the part people find surprising. The case is built on what happens to a citizen or permanent resident family member if you are denied, and it has to be more than the ordinary difficulty any family would face. It is proven with records, not adjectives.
What is the difference between an I-601 and an I-601A?
Timing. The I-601A provisional waiver is filed and decided while you are still in the United States, so you travel for the interview already knowing the answer. The I-601 is generally filed after a finding of inadmissibility. For families, the difference between the two can be months apart instead of years.
Who counts as a qualifying relative?
It depends on the waiver, and children often do not count. Many waivers require hardship to a citizen or permanent resident spouse or parent, and hardship to your children may not qualify on its own no matter how real it is. Confirming who your qualifying relative is comes before anything else.
Is a waiver guaranteed if I have a strong case?
No. Waivers are discretionary. Meeting the legal standard makes approval possible, not automatic, and the officer weighs the whole picture. Anyone who promises you an outcome on a waiver is telling you what you want to hear. What we can do is build the strongest record the facts support.

General information about Utah law, not legal advice, and reading it does not create an attorney-client relationship. Every case turns on its own facts.
