Your Immigration Attorney

Kevin Richards is federally admitted to practice immigration law in every state.

Kevin G. Richards

That's not a marketing claim. It's an actual federal credential — admission to the U.S. Immigration Court, all states. Kevin can represent a client in removal proceedings in any immigration court in the country, and does.

What that means for you:

  • If your case gets transferred to a different state's immigration court (ICE does this regularly with detained cases), you don't have to find a new attorney.
  • If your family member is in detention out of state, we can represent them there without handing the case off.
  • If you're appealing a denial to the BIA or the Tenth Circuit, Kevin handles both.

Kevin is also trilingual — fluent in English, Spanish, and Portuguese. Consultations happen in the language you're most comfortable in.

And: Kevin serves as a public defender in Weber County. He knows criminal-immigration consequences — the dangerous intersection where a small criminal matter triggers deportation — as well as anyone practicing in Utah.

Why Choose Richards & Richards for Your Family Petition

Immigration cases turn on paperwork, deadlines, and who is reading your file. Here is what you get when you hire us.

1

You Get a Real Filing Plan

After your consultation you get a written summary of where your family stands: which category the relationship falls in, what the wait realistically looks like, what has to be filed and when, and what could block admission at the end of it.

2

One Attorney, One Point of Contact

The attorney on your case handles your case. You are not shuffled between five lawyers or handed to a paralegal who cannot make decisions. When you call, you reach the person who knows your file.

3

Federally Admitted in Every State

Kevin Richards is admitted to practice before the U.S. Immigration Court in every state. If your case is transferred, or a family member is detained somewhere else, it does not have to change hands.

4

We Are Transparent About Costs

You get our rate and retainer requirement upfront, plus an honest estimate of what the work costs through resolution. We also tell you plainly what we cannot promise, because no lawyer can promise you an outcome.

5

Clear Communication, Always

We answer calls and emails within 24 business hours. When something significant happens on your case, you hear it from a person, not a form letter. We explain what it means and what happens next.

6

A Family Firm Since 1988

Two generations of Ogden-raised attorneys. We are invested in this community, and we built this firm on the principle that you are not just a case number.

I cannot say enough good things about Kevin and his team. Going through a high-conflict divorce and custody case has been one of the most stressful and emotionally draining experiences of my life, and Kevin has been a steady source of guidance, support, and reassurance throughout the entire process. From the very beginning, Kevin took the time to explain every step of the process, answer my questions, and help me understand what to expect. When I felt overwhelmed, anxious, or uncertain, he helped keep me grounded and focused on the bigger picture. His calm and confident approach gave me peace of mind during some of the most difficult moments of my case…

Questions We Get About Family Petitions

Short answers to what people actually ask before they call.

Which relatives can I petition for?
It depends on whether you are a citizen or a permanent resident. Citizens can petition for spouses, children, parents, and siblings. Permanent residents can petition for spouses and unmarried children. The relationship determines the category, and the category determines everything that follows.
How long will my relative have to wait?
Immediate relatives of citizens wait on processing. Everyone else waits in line. Preference categories are capped each year and the waits vary enormously by category and country of birth. We will tell you where your case actually sits rather than quote an average.
Does an approved petition mean a green card?
No, and this is the misunderstanding that hurts people most. An approved petition establishes the relationship. Your relative still has to be admissible, and issues like unlawful presence or certain findings can block the green card even with an approved petition in hand.
Can my relative wait here while the petition is pending?
Sometimes, and sometimes leaving is what triggers the problem. Whether someone can stay, work, or travel depends on their current status and their history. This is the question worth asking before anyone buys a plane ticket.
What happens if my situation changes?
It can change the category, and sometimes the wait. Marriage, the end of a marriage, a child turning 21, or the petitioner naturalizing can all move a case between categories. Some of those changes help and some hurt, and a few are worth timing deliberately.

General information about Utah law, not legal advice, and reading it does not create an attorney-client relationship. Every case turns on its own facts.
