Federally admitted in every U.S. immigration court
Years practicing immigration law
Languages: English · Español · Português
Kevin Richards is federally admitted to practice immigration law in every state.

That's not a marketing claim. It's an actual federal credential — admission to the U.S. Immigration Court, all states. Kevin can represent a client in removal proceedings in any immigration court in the country, and does.
What that means for you:
- If your case gets transferred to a different state's immigration court (ICE does this regularly with detained cases), you don't have to find a new attorney.
- If your family member is in detention out of state, we can represent them there without handing the case off.
- If you're appealing a denial to the BIA or the Tenth Circuit, Kevin handles both.
Kevin is also trilingual — fluent in English, Spanish, and Portuguese. Consultations happen in the language you're most comfortable in.
And: Kevin serves as a public defender in Weber County. He knows criminal-immigration consequences — the dangerous intersection where a small criminal matter triggers deportation — as well as anyone practicing in Utah.

I cannot say enough good things about Kevin and his team. Going through a high-conflict divorce and custody case has been one of the most stressful and emotionally draining experiences of my life, and Kevin has been a steady source of guidance, support, and reassurance throughout the entire process. From the very beginning, Kevin took the time to explain every step of the process, answer my questions, and help me understand what to expect. His calm and confident approach gave me peace of mind during some of the most difficult moments of my case…Ashley N.
Kevin Richards has represented me for several years through multiple complex cases, including an ex parte TRO, a custody modification, and a DCFS case. Request a Consultation →Questions We Get About Immigration Appeals
Short answers to what people actually ask before they call.
- How long do I have to appeal?
- Not long, and the deadline is strict. An appeal from an immigration judge to the BIA generally has to be filed within 30 days of the decision, and the Board is not forgiving about it. Other routes carry their own deadlines. Bring the paperwork to us as soon as you get it rather than after you have thought it over for a few weeks.
- What happens to my removal order while the appeal is pending?
- A timely appeal generally holds the order while the Board reviews it. That is one of the main reasons filing on time matters so much. What protection you have, and for how long, depends on the posture of your case, which is worth confirming rather than assuming.
- What is the difference between an appeal and a motion to reopen?
- An appeal says the decision was wrong on the record. A motion to reopen says there are new facts. They go to different places, run on different deadlines, and are judged by different standards. Choosing the wrong one wastes the window for the right one.
- What are my chances on appeal?
- Honestly, reversal rates are low, and any lawyer who promises you otherwise is selling something. That is exactly why the appeal has to be built on a specific identifiable error rather than a general disagreement with the outcome. We will tell you if we do not see one.
- Do I need a lawyer for an immigration appeal?
- An appeal is a written legal argument, not a second hearing. You do not get to retell your story; you have to show what the judge or the agency got wrong, citing the record and the law. That is a different skill from the original case, and it is where representation matters most.
General information about Utah law, not legal advice, and reading it does not create an attorney-client relationship. Every case turns on its own facts.
