Alimony Attorney in Utah

Skilled negotiation. Straight answers. Your future protected.

Utah has no alimony formula. A judge weighs need, earning capacity, and ability to pay, and small differences in how those numbers are presented change the award by thousands of dollars and by years. At Richards & Richards, we build the financial record before the judge builds the order.

Meet Your Attorney

Jaime Richards leads our family law practice.

Utah alimony comes down to three things: need, ability to pay, and the standard of living you had. Jaime is the patient explainer, and a strategic fighter when the case calls for it. He’ll walk you through it without making you feel stupid for asking the same question twice, and he’ll fight hard when needed: when another attorney dropped the ball, when the other side is running up your clock with discovery games, or when you’ve been told to expect an outcome you’re not willing to accept.

To better address our Hispanic community, three other attorneys at the firm speak Spanish: Kevin, Carl, and Roy. Jaime speaks Portuguese. Consultations happen in the language you’re most comfortable in, not through a translator.

How Alimony Comes Up in Utah Cases

Alimony, also called spousal support, is money one spouse pays the other after a marriage ends. It reaches us at four points, and each one is argued differently.

Why Choose Richards & Richards for Your Alimony Case

Alimony is the part of a Utah divorce where clients feel the least informed. The number seems to arrive from nowhere and nobody explains what moved it. Here is how we work.

1

You Get a Real Alimony Analysis

After your consultation we give you a written summary of the range a Utah judge is likely to consider, which factors help you, which ones hurt, and what we would need to document to move the number. You should not have to pay a retainer to find out where you stand.

2

One Attorney, One Point of Contact

The attorney on your case handles your case. You are not shuffled between five lawyers or handed to a paralegal who cannot make decisions. When you call, you reach someone who already knows your situation.

3

Patient Explainer, Strategic Fighter

Jaime Richards leads our family law practice. He walks you through the process without making you feel stupid for asking the same question twice, and he pushes hard when the case calls for it.

4

We Are Transparent About Costs

You get our hourly rate and retainer requirement upfront, plus an estimate of what the work costs through mediation. We also tell you plainly what we cannot predict, because the rest depends on the other side’s conduct and how quickly you reach agreement.

5

Clear Communication, Always

We answer calls and emails within 24 business hours. When something significant happens on your case, you hear it from a person, not a form letter. We explain what is happening, and why, in plain English.

6

A Family Firm Since 1988

Two generations of Ogden-raised attorneys. We are invested in this community, and we built this firm on the principle that you are not just a case number.

Ready to talk it through? A one-hour consultation is $100, credited to your retainer if we take your case.

I came to Richards and Richards to represent me on my divorce. Kevin and his team were amazing to work with from the start. Gave it to me straight and didn't jerk me around. What People Ask Us About Utah Alimony

These come up in almost every first consultation. Here is what we tell people.

How long does alimony last in Utah?
Utah limits how long alimony can run, and the length of the marriage is the main reference point. Courts can order less, and the duration also depends on the recipient’s ability to become self-supporting and on what the decree itself says. Because the rule carries limits and exceptions, do not assume a figure you have read applies to you. Give us your dates and we will tell you.
How is alimony calculated in Utah?
Utah has no alimony formula or calculator. A judge weighs the receiving spouse’s financial need, that spouse’s earning capacity, the paying spouse’s ability to pay, the length of the marriage, whether there are children at home, and the standard of living during the marriage. Because there is no formula, how your income and expenses are documented drives the number, and that is the part Richards & Richards controls for you.
How much alimony will I have to pay in Utah?
There is no formula. Alimony is built from need, ability to pay, and the standard of living during the marriage. In practice an award sits somewhere between what one spouse reasonably needs and what the other can realistically afford, and both budgets get scrutinized line by line. Bring us your finances and we will tell you the likely range.
Does cheating affect alimony in Utah?
It can. Utah is a no-fault divorce state, but the alimony statute allows a judge to consider fault, including adultery that substantially contributed to the end of the marriage. It is one factor among many and rarely decides a case by itself. How much weight it carries varies by judge, which is why knowing your court matters.
Can alimony be modified after the divorce is final?
Yes, if you can show a substantial and material change in circumstances that was not foreseeable when the decree was entered. A layoff, a disability, or a large income change can qualify. A voluntary pay cut usually does not. Until a judge signs a new order the original amount keeps accruing, so the filing date matters more than most people realize.
Does alimony end if my ex remarries or moves in with someone?
Remarriage and cohabitation both affect alimony, but they do not work the same way. One generally ends it outright. The other typically means going back to court and proving the living arrangement, which is a harder thing to do than it sounds. Timing matters, and so does the language of your decree. Call us before you stop paying, because stopping on your own can cost you.
What happens if my ex stops paying alimony?
Unpaid alimony becomes a judgment you can collect. A court can order wage garnishment, intercept tax refunds, seize bank accounts, add interest, hold the payer in contempt, and order them to pay your attorney fees. Disagreeing with the order is not a defense to not paying it.
Can I avoid paying alimony in Utah?
You can reduce or defeat an award, but not by hiding income. The legitimate arguments are that the other spouse has no real need, that they have earning capacity they are not using, that a property trade is the better structure, or that the marriage was too short to support a long award. Concealing income typically produces a larger award plus a fee sanction.
Is alimony taxable in Utah?
It depends on when your divorce was finalized, because the federal tax treatment of alimony changed. Orders entered before and after that change are handled differently, and modifying an older order can alter which rule applies to it. This is a question with real money attached, so confirm it with us or your accountant rather than with a search result.

The Number Follows You for Years

Alimony is decided once and lived with for a long time. Spread across the length of a Utah marriage, it is often the largest single financial term in the entire decree, and it is the one most people understand the least on the day they sign it.

Richards & Richards has been an Ogden family firm since 1988. You get one attorney who knows your case, a former prosecutor who knows how judges think, and a straight answer about what your case is worth before you spend money finding out.

Argue the number now, or live with it for years.
